The court of appeals in Kansas City upheld a lower court ruling Tuesday from Cole County Judge Dan Green to grant a new public hearing regarding a quarry near Saxony Lutheran High School. The judgment requires Heartland Materials, LLC, to undergo a public hearing for its mine permit that allows the company to operate a quarry near the school. A group called ‘Save our Children's Health’ joined with the school to challenge permits to the Heartland quarry and another operated in the area by Strack Excavating. St. Louis attorney Steven Jeffery, representing Saxony and Save our Children tells KZIM-KSIM the Land Reclamation Commission decides when that hearing takes place. Strack's appeal to an order vacating its permit is set for next month, and their mining operations were suspended during the appeals process. The Heartland Materials case was heard in Missouri's Western District Court of Appeals on appeal from Cole County, where the Land Reclamation Commission operates.
