George Joseph’s defense motion to suppress his hospital room interview denied

Oct 30, 2013 -- 4:00pm

Defense for George Edwin Joseph, who was accused of killing his wife and son in May, was overruled Tuesday when they asked the court to suppress evidence. George Joseph was formally charged with first degree murder and armed criminal action in May. He allegedly shot and killed his wife, Mary, and 18-year-old son Matthew at their home on West Cape Rock Drive. His defense filed a motion to suppress a two hour recorded interview conducted by the Cape PD while Joseph was hospitalized with head wounds. Attorney Bryan Greaser claimed Joseph repeatedly asked to speak with his attorney during the interview, thus making the confession invalid. The cops who conducted the interview claimed that even though he was in the hospital, his “speech was not slurred” and “he never drifted off.” They felt he was of sound mind. Judge Benjamin Lewis agreed, and overruled this request claiming he saw no violation of Joseph’s constitutional rights.
