A Cape Central teacher found not guilty on assault

A Cape Central High School teacher facing misdemeanor assault charges after an incident with a student in downtown Cape is found not guilty by jury.  32-year old Roman Smith of Sikeston was charged with assault in the 3rd-degree for allegedly choking a student to unconsciousness.  According to Cape P-D, on January 21st, a 16-year-old male student contacted Smith in a downtown parking lot and the two began to “Play Fight”.  Smith allegedly wrapped his legs around the student’s back and applied a choke hold, forcing the student to pass out.  The jury returned a not guilty verdict late Friday in Jackson.  Smith has resigned from Cape Schools.
